I acknowledge and agree that Swiss Security Solutions LLC will forward my application to Credit General AG, partner of Cembra Money Bank AG, Bank-Now AG, Cantonal Bank of Geneva (hereinafter referred to individually as the “financial institution”) by Internet, e-mail or fax/mail. In addition, I confirm the following points:
Application review and credit information: I confirm that all my details are correct and I authorize the financial institution to obtain information about me from third parties, in particular banks, the Central Credit Information Office (ZEK), authorities (e.g. debt enforcement agencies, land registry offices, etc.) and other interested parties in order to review this application and process the contractual relationship. These include banks, the Central Credit Information Office (ZEK), authorities (e.g. debt enforcement agencies, land registry offices, tax authorities, residents’ registration offices, child and adult protection authorities), financial information companies, credit intermediaries, employers, companies belonging to the financial institution’s group and, if applicable, the Association for the Management of a Consumer Credit Information Centre (IKO). For the above-mentioned purposes, I release these organizations from the obligation of bank, postal, official or business confidentiality. I also authorize the financial institution to report this application to the ZEK and, if applicable, to the IKO and, in the event of a legal obligation, to other organizations. In particular, the type, amount and terms of the credit or financing, as well as the applicant’s personal data and any qualified late payments or misuse of credit are to be reported. I acknowledge that the ZEK and the IKO have the right to provide their members with information about the data provided. The financial institution may refuse the request without giving reasons.
Cooperation with intermediaries: In the case of applications submitted by an intermediary, the financial institution may exchange information with the intermediary that is necessary to check the application/creditworthiness and to conclude and execute the contract.
Partner’s data: If I have included details of my spouse or registered partner (“partner”) in the application, I confirm that (i) I have informed my partner of this application, (ii) the financial institution can verify the above details directly with my partner, and (iii) my partner agrees that the financial institution may obtain information about him/her (including inquiries to the ZEK) as described above.
Data processing: I authorize the Financial Institution to process and evaluate my data for marketing and risk management purposes and to create profiles in this respect. I authorize the financial institution to offer me other products and services, including those of its group companies. I can revoke this consent at any time for the processing of my data for marketing purposes or for sending me information.
Collaboration with service providers (outsourcing): The financial institution may outsource services to third parties (hereinafter referred to as “service providers”), in particular with regard to the processing of business processes, IT security and systems management, market research and development, the determination of business-relevant credit and market risks, as well as the administration of contractual relationships (e.g. processing of applications and contracts, collection, communication with customers). The financial institution provides these service providers with the data necessary to fulfill their contractual obligations and may transmit this data abroad for this purpose. The service providers, as well as their employees and subcontractors, are contractually obliged to ensure data protection in accordance with the requirements of the Federal Data Protection Act, to observe banking secrecy in accordance with the Federal Banking Act and to comply with the duty of confidentiality. In this context, I acknowledge that my data may be transmitted to service providers in countries which may not have data protection equivalent to that of Switzerland.
I agree that the financial institution may use electronic means to communicate with me or the intermediary. I also agree to the transmission of data via the Internet and I am aware that the Internet is an open network accessible to everyone. Therefore, Swiss Security Solutions GmbH and the financial institution cannot guarantee the confidentiality of data transmitted via the Internet. This means that third parties may conclude that there is a current or future business relationship (if any) between myself and the financial institution.
The granting of a Loan is prohibited if it leads to over indebtedness (Art. 3 UWG).
